Word Hurdle — Terms of Service

These terms are an agreement between you and RopoLabs ("we", "us"), covering the Word Hurdle app for iOS and everything in it.

By playing Word Hurdle you accept these terms. If you do not accept them, please do not use the app. How we handle your information is covered separately in our Privacy Policy.

1. Who can play

You must be at least 13 years old, or the minimum age for consent to online services where you live, whichever is higher. If you are under the age of majority, you may only use Word Hurdle with the involvement of a parent or guardian, who accepts these terms with you.

2. Your account

An anonymous account is created for you the first time you open the app, so that your progress and purchases persist. You do not have to sign in to play, and you can optionally link Sign in with Apple, an email address, or Game Center.

You are responsible for the security of any account you link. Do not share your credentials. Tell us at support@ropolabs.com if you think someone else is using your account.

One person, one account. Do not create multiple accounts to gain an advantage on leaderboards, to claim one-time rewards more than once, or to evade a restriction.

You can delete your account at any time from Account → Delete account in the app. What that removes and what it keeps is set out in Section 9 of the Privacy Policy.

3. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Word Hurdle for your own non-commercial entertainment, on Apple devices you own or control, in line with Apple's own App Store terms.

You may not: copy, modify, translate, reverse-engineer, decompile, or extract source code or word lists from the app except to the extent that law expressly permits despite this restriction; rent, lease, sell, or sublicense it; remove any notices; or use it in a way that breaks the law.

Word Hurdle, its name, its design, its puzzles and its content are ours or our licensors' and stay that way. These terms give you no ownership of any part of it.

4. Fair play

Word Hurdle's scores are verified on our servers. The following are not allowed:

  • modifying, tampering with, or automating the app or the device clock to affect results
  • using bots, scripts, solvers, emulated input, or intercepting or forging our network traffic
  • exploiting a bug rather than reporting it, particularly one affecting currency, rewards, or scores
  • creating accounts to farm one-time rewards
  • interfering with our servers, or attempting to access accounts or data that are not yours

We run automated checks for results that could not have been produced by honest play. An account those checks flag is removed from all public leaderboards. Where we find deliberate abuse, we may additionally reset progress, revoke rewards, restrict features, or close the account. If you think a decision about your account is wrong, write to support@ropolabs.com and a person will review it.

We do not refund purchases forfeited because of a breach of this section.

5. Purchases, gems, and subscriptions

All purchases are processed by Apple, under Apple's terms and using your Apple Account. We never receive your payment details.

Gems and other in-game items

Gems are a virtual in-game item, licensed to you for use inside Word Hurdle. They are not money and have no cash value. They cannot be sold, transferred between accounts, exchanged for anything outside the game, or redeemed for cash, and they are not refundable except where the law or Apple requires it. Unused gems are lost when you delete your account, and if we discontinue the app or a feature (Section 8).

Gems can also be earned for free by playing and by watching rewarded ads. We may change what gems cost, what they buy, and how many a given action grants, as the game is balanced.

Subscriptions

Word Hurdle offers auto-renewable subscriptions, currently Pro (monthly and yearly) and the Daily Monthly Pass, along with the one-off non-consumable Remove Ads. Current prices, durations and benefits are shown in the app before you buy.

Auto-renewal, as required by Apple:

  • Payment is charged to your Apple Account at confirmation of purchase.
  • The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period, at the price for the plan you chose.
  • You can manage and cancel subscriptions in iOS Settings → your name → Subscriptions after purchase. Deleting the app does not cancel a subscription.
  • Cancelling stops the next renewal; it does not shorten the period you have already paid for.
  • Any unused part of a free trial, where one is offered, is forfeited when you buy a subscription.

Refunds are handled by Apple, not by us. Request one through Apple at reportaproblem.apple.com. If Apple asks us for information while deciding a refund, we respond as described in Section 5 of the Privacy Policy.

Restoring purchases. Purchases are tied to your Apple Account and can be restored on your devices. Because a transaction can only ever be redeemed once, we keep a record of every transaction even after you delete your account.

6. Leaderboards, challenges, and what you post

Your display name and scores are public and readable by anyone, including people without an account. See Section 4 of the Privacy Policy.

When you choose a display name or create a challenge, you are publishing content that other people will see. You must not choose a name or a word that is obscene, hateful, harassing, deceptive, impersonates someone else, or infringes anyone's rights. We filter names automatically, but no filter is perfect.

You keep whatever rights you have in what you create. By publishing it in the app you grant us a worldwide, royalty-free licence to host, display and distribute it inside Word Hurdle for as long as it is part of the game. We may remove any name or challenge, or reset a name to an assigned one, at our discretion, and we may keep challenges and their results after your account is deleted because other players' results depend on them.

7. Advertising

Unless you have bought Remove Ads or Pro, Word Hurdle shows advertising. You can also choose to watch rewarded ads for gems. Ads come from third parties, and we do not control and are not responsible for their content or for anything you do with an advertiser. See Section 6 of the Privacy Policy for what advertising means for your data.

8. Changes to the game and to these terms

Word Hurdle is a live game. We may add, change, or remove modes, puzzles, features, prices and rewards, and we may suspend or discontinue the app or any part of it. Where a change materially affects something you have paid for, we will act reasonably and, where the law requires it, offer an appropriate remedy.

We may update these terms. If a change materially affects you, we will update the date at the top and notify you in the app before it takes effect. Continuing to play after that means you accept the updated terms.

9. Ending this agreement

You may stop at any time by deleting your account and the app.

We may suspend or end your access if you break these terms, if we are required to by law, or if we discontinue the app. Where the reason is not a serious breach on your part, we will give reasonable notice where we can.

Sections 3, 5 (as to gems already forfeited), 6 (as to content already published), 10, 11 and 12 survive the end of this agreement.

10. Disclaimers

Word Hurdle is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of loss of data or progress, or that leaderboards will always be accurate.

Nothing here excludes any right you have as a consumer that cannot be excluded under the law of your country, or our liability for death or personal injury caused by negligence, or for fraud.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost progress, lost gems, or lost data.

Our total liability arising out of or relating to Word Hurdle is limited to the greater of the amount you paid us through the app in the twelve months before the claim, or US$50.

12. Apple

These terms are between you and us, not with Apple, and Apple is not responsible for Word Hurdle or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim that the app or your use of it infringes intellectual property rights, breaches consumer law, or fails to meet a legal requirement. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

13. General

If any part of these terms is unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of our business. These terms, with the Privacy Policy, are the whole agreement between us about Word Hurdle.
